The provisions of this Article shall apply when the payer issues a payment services order through the payment creation service.
2.
The payments account service provider shall refund to the payer the amount of the unexecuted or defective payment transaction and restore the debit payments account to the state it would have been in had the defective payment transaction not been executed.
3.
The payment creation service provider shall compensate the payments account service provider upon request - immediately - for any loss resulting from the refund of amounts to the payer, when the payment creation service provider fails to prove the following:
A.
Receive a payment services order by the payer’s payments account service provider pursuant to Article 72 of the Regulations.
B.
Demonstrate that the payment transaction has been accurately certified and recorded and has not been affected by a defect in relation to non-execution, defective or late execution within the scope of the payment creation service provider's activities.
